The Refugee Act of 1980 established procedures for those foreign nationals physically present in the US seeking asylum. Asylum applications may be submitted affirmatively to an Asylum office within one year after the persons entry in the U.S. This one year time limit can only be overcome by a showing of changed circumstances which materially affect the person's eligibility or extraordinary circumstances regarding the delay in filing the application.
